FEDERATION 2 TERMS AND CONDITIONS

1. INTRODUCTION
These Terms and Conditions are the contract that you enter into with ibgames when you set up an account to play Federation 2. The Terms and Conditions set out your responsibilities to ibgames, and ibgames's responsibilities to you.
By setting up an account with ibgames, you agree to abide by these Terms and Conditions, and by the Federation 2 Rules which set out standards of behavior.
These documents are collectively called the "Terms", and are binding agreements.
We have attempted to set out the details of the Terms in plain English rather than "legalese". If you are unsure about anything in the Terms, please ask by emailing feedback@ibgames.com.
2. CHANGES TO THE TERMS AND CONDITIONS
Ibgames may change the Terms at any time, and the changes will take effect immediately.
Details of changes to the Terms will be published on the What's New in Federation 2 page of the ibgames web site at http://www.ibgames.net/fed2/whatsnew.html, and in the weekly news bulletins for the game. It is your responsibility to review the rules from time to time so that you are aware of any changes.
If you find a change unacceptable, then you may cancel your Fed2 account (as explained in section 15 of this document). If you continue to play Fed2, then you are accepting those changes.
3. YOUR ACCOUNT
ibgames's games and products are intended for adults and in order to open a Federation 2 account you must be at least 18 years old, or have the permission of your parent or guardian to open an account.
Once you have opened an account you may change your password or registered email address using commands in the game, which are listed in the game manual.
4. ACCOUNT SECURITY
When setting up a Fed2 account you choose an account ID and a password, which you then use whenever you wish to access the game.
The security of your account is your responsibility. ibgames will not repair any damage done to your account or game character if another person uses your account.
You should never give your password to anyone. Nobody from ibgames will ever ask you for your password, for any reason.
You are responsible for all activities conducted using your Fed2 account. If you allow another person to use your account, and they break the rules or misbehave, you will have to take the responsibility.
5. EMAIL ADDRESS
The only personal information we ask you to provide when setting up an account is your email address. We use this email address to identify you in the case of any problems with your account. If you change your email address you must update our records to show your new email address, otherwise we will have no proof that the account belongs to you.
We require you to give a valid email address when you set up an account with us, and to make sure you update the email address in our records if you should change your email address.
If we need to write to you for any reason about your account, and the email bounces because the email address in our records is wrong, or if you do not answer our email within one week, then we may suspend the account until you get in contact with us.
6. COPYRIGHT
ibgames's site contains games, products, information, software, graphics, sounds, and other material which are collectively called "Content". Some of this Content is wholly owned by ibgames, in which case we own the copyright on the Content. Some of the Content is licensed from third parties, or provided by other ibgames users, in which case the originator of the work owns the copyright.
ibgames owns a copyright in the selection, coordination, arrangement and enhancement of such Content.
Any Content on the site is provided for your personal use only, subject to the copyright, trademarks, and other intellectual property rights which may apply.
7. SOFTWARE LICENCES
Some of our games and products can be accessed using special software provided by ibgames, either to provide extras to the basic product, or as the only way to access the product. Unfortunately we cannot guarantee to provide software for all types of computers.
ibgames grants to you a non-exclusive, limited license to use any ibgames software necessary to play the games on the ibgames site.
You may use the software for your personal use within our games and products.
8. CONDUCT AND COMMUNICATION
Communication in Fed2 is "real time". This means we do not pre-screen any communications that occur in the game. However we will do our best to remove offensive material in a timely manner once it is brought to our attention, and to deal with people who consistently break the rules.
The Fed2 Rules set out standards of behavior which we expect from our users. If you break the rules, you may be barred from the game, either temporarily or permanently.
9. PRIVACY POLICY
Because protecting your privacy is very important to ibgames, we have established a privacy policy that safeguards your personal information, and we are committed to protecting its confidentiality. We will limit the collection and use of personal information to what is necessary to administer our business and provide you with the highest quality service.
The only information we maintain about you is your email address, billing history and payment information.
We may also keep information on your communications with our Customer Service department, and general account history, such as usage details or written complaints relating to your account. We safeguard this information from unauthorized access and only authorized employees are permitted access to your information. Employees who violate ibgames's privacy policies are subject to disciplinary actions, including termination where appropriate. We may use agents, who are bound by strict confidentiality guidelines, to perform storage, processing, and other limited functions on ibgames's behalf.
We use identity and billing information to administer our business, and ensure that you are properly billed.
We will never make our mailing list available to anyone else for the purpose of sending bulk mail, and we will never send mail to you on behalf of anyone else. Nor will we send out bulk mailings to all players even on our own behalf!
We maintain subscription mailing lists that you can subscribe to in order to receive important information from us. You choose to subscribe to these lists, and you can remove yourself from them at any time.
We may send you individual mailings if we need to contact you about your account or about any problems.
We will never tell other players your email address.
We will never give any information about your account to anyone unless the request comes from the registered email address for the account. (This is one of the reasons why it is important for you to make sure your registered email address is correct.)
We will never release any other information about you that may come into our possession, such as telephone numbers, credit card numbers, usage, navigational or transactional information.
Any communication or correspondence between you and ibgames is kept confidential and the details are never disclosed to anyone else.
Our policy is not to disclose any information to anyone that would link your game character name with your actual name, unless we are required to do so by law or legal process served on ibgames (eg a subpoena). We reserve the right to make exceptions to this policy in extraordinary circumstances (such as a bomb or suicide threat, or instances of suspected illegal activity) on a case-by-case basis.
If ibgames should be under a legal obligation to disclose any information about you, we will make efforts to notify you in advance of releasing it so that you have the opportunity to seek legal protection.
10. DONATIONS TO FEDERATION 2
Federation 2 is a free game but we provide two methods for you to make donations: individual payments and a monthly subscription, both administered by PayPal. Money donated is used to pay Fed's running costs.
In return for donations we give you slithy toves, which can be exchanged in the game for various items.
Donations will not be refunded if you decide to stop playing the game, or if you change your mind about the donation, or you lose the slithy toves because your character dies, or if your character is locked out either temporarily or permanently.
11. WARRANTY
Part of the contract between you, the user, and ibgames is that you agree that your use of Fed2 and the ibgames site, and any software provided by ibgames, is at your sole risk.
The ibgames site, games and products are provided "as is" and "as available" for your personal use. ibgames provides access to its site, games and products on a commercially reasonable basis and does not guarantee that you will be able to access the service at all times or from all locations. We will endeavor to give you advance warning of maintenance that will prevent your using the service but that will not always be possible.
ibgames has no responsibility for problems you may experience while trying to access the service which are caused by internet delays or routing problems.
12. INDEMNIFICATION
If anything you do on the ibgames site, games and products, results in legal actions being taken against you, then you are responsible for your own legal costs, claims and expenses. In addition, if your actions result in legal action against ibgames, then you are also responsible for our legal costs, claims and expenses.
If this happens, ibgames reserves the right to assume the responsibility for and control over the defense of the matter, in which case you are no longer responsible for ibgames's costs, claims and expenses.
13. CHARACTER DELETION
From time to time we delete unused game characters from the persona file in order to save storage space, and to free up unused names for use by other players. Characters at the ranks GroundHogs and Commanders are considered unused if they have not been logged into the game for 30 days and have no unused slithy toves (except for the free slithy that Groundhogs are issued with at the start, which is used to buy a ship permit). Higher ranks are considered unused after six months.
We may also delete individual unused characters if another player requests that the name be freed up.
If you want to stop playing Fed2 but don't want your character to be deleted, just make sure you log on every couple of months.
14. LAW
While you play Fed2 or use the ibgames site, games and products, you are subject to the laws applicable to the location from where you are logging on, including local, state and national laws.
The laws of the Isle of Man govern the terms of your account and in the case of any disputes between you and ibgames the resolution of the disputes shall be settled in the courts of the Isle of Man.
